1.4 Our website incorporates privacy controls which affect how we will process your personal data. The source of the service data is what the customer provided on account creation and by adding images to their account. The service data may be processed for the purposes of operating our website, providing our services, ensuring the security of our website and services, maintaining back-ups of our databases and communicating with you. The legal basis for this processing is our legitimate interests, namely the proper administration of our website and business.
3.5 We may process information relating to transactions, including purchases of goods and services that you enter into with us and/or through our website (“transaction data”). The transaction data may include your contact details and the transaction details. The transaction data may be processed for the purpose of supplying the purchased goods and services and keeping proper records of those transactions. The legal basis for this processing is the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract and our legitimate interests, namely the proper administration of our website and business.
3.6 We may process information contained in or relating to any communication that you send and/or provide us with (“correspondence data”). 3.10 We may process student data provided in the course of providing our services (“student data”). The student data may include the name, class/form and admission number of the student. The source of the student data is the school. The student data may be processed for the purposes of providing the services that school have requested. The legal basis for this processing is consent from the school with the agreement that they have the permissions to give this consent.
3.11 We may process photograph data created in the course of providing our services (“photograph data”). The photograph data may be processed to provide the service we have been contracted to complete. The legal basis for this processing is consent.
3.12 In addition to the specific purposes for which we may process your personal data set out in this Section 3, we may also process any of your personal data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
3.13 Please do not supply any other person’s personal data to us, unless we prompt you to do so.
4. Providing your personal data to others – To comply with Article 13(1)(e) and 14(1)(e) of the GDPR
4.1 Financial transactions relating to our website and services are handled by our payment services providers, Stripe and Paypal. We will share transaction data with our payment services providers only to the extent necessary for the purposes of processing your payments, refunding such payments and dealing with complaints and queries relating to such payments and refunds. 4.2 In addition to the specific disclosures of personal data set out in this Section 4, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
5. International transfers of your personal data – To comply with Article 13(1)(f), 46, 47 and 49 (1) of the GDPR
5.1 There are no circumstances in which your personal data will be transferred to countries outside the European Economic Area (EEA).
6. Retaining and deleting personal data – To comply with Article 5(1)(e) and 89(1) of the GDPR
6.1 This Section 6 sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.
6.2 Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.
6.3 We will retain your personal data as follows:
(a) account, service and notification data will be retained for a maximum period of 5 years following the last date of account activity.
(b) transactional data will be retained for a maximum period of 7 years following order date.
(c) correspondence and enquiry data will be retained for a maximum period of 2 years following the original correspondence or enquiry date.
(d) school student data will be retained for a minimum period of 2 months and for a maximum period of 6 months following the received date.
6.4 In some cases it is not possible for us to specify in advance the periods for which your personal data will be retained. In such cases, we will determine the period of retention based on the following criteria:
(a) the period of retention of usage data will be determined based on its remaining usefulness for analysis.
(b) the period of retention of marketing data will be determined based on the consent still being valid, once consent is removed so is the data.
(c) the period of retention of photographic image data will be indefinitely, as a part of our archive, as this is important intellectual property of the company.
6.5 Notwithstanding the other provisions of this Section 6, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
7. Amendments
7.1 We may update this policy from time to time by publishing a new version on our website.
7.2 You should check this page occasionally to ensure you are happy with any changes to this policy.
8. Your rights – To comply with Article 13(2), 6(1), 7(3), 9(2), 14, 15, 16, 17, 18(1), 21 and 77 of the GDPR

8.11 To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.

9. About cookies

Environmental Policy
Introduction and Aim
The School Photography Company, as part of its company commitments, recognises its obligations to comply with the law and to carry out its business in an as environmentally sound manner as possible. We are therefore committed to reducing our environmental impact and continually improving our environmental performance as an integral and fundamental part of our business strategy and operating methods.
It is our priority to encourage our staff, customers, suppliers and all business associates to do the same. Not only is this sound commercial sense for all, it is also a matter of delivering on our duty of care towards future generations.
We are the first UK school photographers to go single use plastic-free. Our bespoke system allows parents access to all their photos taken with one order form per child, this is greatly reducing paper wastage.

The moulding for our frames is purchased from a supplier that has a certified woods policy and meets the required standards and has FSC and PEFC Certification.
Our mounts are fully recyclable and compostable; they are produced from sustainable forestry and have FSC and PEFC certification. The UK paper mill that they are sourced from is 100% carbon neutral and all their energy is produced with their newly constructed bio-mass boiler. This means the mill boasts a world class standard when it comes to clean, efficient energy systems used for their production.
Our cardboard packaging is made from recycled and sustainable sources and is also recyclable for our end user. The company that makes our packaging is FSC accredited and has attained ISO 9001.

GDPR Statement
UK General Data Protection Regulation, or GDPR, has updated how businesses process and handle data. It came into force on 31st December 2020 and sits alongside an amended version of the DPA 2018, protecting the personal information of individuals. These data protection regulations have required a full audit of our processes to ensure our compliance.
The School Photography Company ensures that any collected or stored data is done so within the boundaries of GDPR and the company’s policies. Data audits are completed every six months to establish that all data held is up-to-date, relevant and necessary. We are committed to working closely with all of our clients to assist them with their GDPR compliance.
